Wet Lands Mitigation Settled

 Here are several pages of the decision by the County as a result, of the recent hearing . Building in a wet lands without  the proper permits and approval has cost the association thousands of dollars in fines and legal fees. These have been paid previously, but approval and additional permits were still needed.  On condition that the association buy into a wet lands property bank and the needed additional permits.are obtained, the matter is settled.  The cost for the wet land property is minimal as to what it could have been. The exact figure is not known at this time, but will be a few thousand dollars.  

We got lucky on this as it sure could have been a lot worse. Had this been handled properly from the start, we would not have found our selves in this situation.  It was a "Rooky" error.
The followers of this blog are probably the only members who will ever know this happened. The complete decision is rather long and mostly legal talk describing County ordinances, etc. This summary pretty much sums it up.

George, you are right, this was a mistake that should not have happened. It must be nice to sit back and criticize those who actually do things. If you don’t do anything you don’t make mistakes. You used to do things and you made mistakes. Some of us remember your veterans park project. Do you remember the mistakes you made? Why did the kiosk have to be moved? How much over budget did you go? You are being hypocritical and you know it. BTW, the veterans park was worth the effort and the mistakes are not what is remembered. Thank you for promoting and taking the lead on that project. When I drive by the park, I have good feelings toward you. I do not call to mind the issues that came up during construction. I just thank you for making it happen.

Making mistakes is one thing, 7:37 AM. Spending other people's money while building without permits, especially other people's money, is not just a mistake, it's against the law and sanctionable as such.

Not only should we maintain what we have, but we should constantly be improving. The Veterans Park should be an example of the values of our community. I will say that Toby did a good job of maintaining our common property this past year and I have recognized him for that as "Employee Of The Year". But, we need to do more.

There is a large pool of water that gathers at the entrance to the foot bridge. I have asked repeatedly that it be filled in with additional gravel. I think the parking area on both sides should be paved, as well as the walking path.

The one post lamp needs to be replaced with a new down cast light as well as three more placed along the path on the West side.

The cross walk across I Street is in the wrong location. It needs to be moved to the North side of 306th, where the people walk. Just a few ideas that I have. And thanks for the appreciation for the park. It was a struggle to get it.

Considering the hoops we members have to jump through for any building or improvements, there is no excuse for bot not getting permits, etc.

Sure there is, they are special you know. They have more important business to do. Like screwing the members. They are busy driving around counting light bulbs.

The mistakes made during the veterans park project cost members money. The neighbors complained to Pacific County about the kiosk. They complained about the kiosk being constructed without a permit. It is not exactly the same, but the mistakes are similar.

I think I need to focus on the wildlife, ocean, and beach.

7:37 - You have a warped attitude as I see it. Whoever you are, volunteering your service as a Comm. member or as a Trustee, your actions are subject to member opinions and criticism. In this role, you have no real choice but to listen to the criticism and decide for yourself if there is something you can agree with, and can take to heart, or dismiss it as insignificant.

Still, as someone who has been criticized in your service, you are not obligated to never criticize others in the same role. I don't know in what universe we are obligated to never criticize others because we ourselves are not perfect.

In particular, decisions to deny members knowledge of major management mistakes accompanied by huge fines, is on a different scale, beyond mere "mistakes". When there is a cover-up knowingly agreed to with others of the BOT, it is NOT a mistake, but a conscious decision to deceive the members, refusing to share public information.

To liken that to the veterans park is to ignore what is ethical, and what is legal. No comparison.

Please explain how/when members requested and were denied knowledge of major management mistakes. I see many comments here but haven't seen any written requests made for specific information. I attended the last annual meeting and for all the build up leading up to it only Mr. Riley asked one question of the BOT. Soon thereafter everyone returned here and started complaining...

Steve, I respect your opinion but that is all it is. In my opinion, you are making mountains out of molehills. Mistakes, large or small are just mistakes. If you volunteer to help your community, that is a good thing. If you make mistakes in the process, that is human. What good comes from hanging out all the dirty laundry? No good comes from it. Nobody will volunteer anymore. Who needs to be so unfairly and harshly criticize for volunteering? Your sanctimonious diatribes against board members does not encourage others to volunteer. In fact it does just the opposite. If you can convince enough members to vote for you in July you can be a trustee. Then others can criticize you.

Give me a break ! Tens of thousands of dollars were paid out in fines for management mistakes in Summer/early Fall of 2018. Only the Blog reported what had taken place with the citing for mishandling of asbestos and abatement costs at about $45,000. Same with the failed permits, cited at about the same time. The Board has kept this Mitigation stuff quiet, making a few quick dismissive comments about it.

In the BOT meeting Sat., it was also skimmed over. We were told that the community was essentially exonerated, which is not accurate. There was no mention that this has cost the membership X number of dollars in legal fees over more than a year and a half, or that we are waiting to hear what the final cost of the land we have agreed to purchase will be.

The County initially said the land may cost as much as $90,000 an acre, and that we would need to buy 12 times as much land as we had violated. Once we had the mitigation attorney on this, our situation improved.

But legal spending is not clearly deliniated in the information we receive as owners, and there is no transparency on many issues, even when members make specific and repeated inquiries for detailed info.

It's obvious that everyone makes mistakes, but being a volunteer in the HOA government is not a pass to screw up repeatedly at great cost to the Assoc., nor to not acknowledge it. Mr. Clancy is a case in point. And the vast sums of money wasted on Tree enforcement legal fees, and failed suits in Superior Court.

Covering up mistakes is what I was emphasizing, and you conveniently ignore that.

Forgive who you want. Condemn who you want. The dollars are not the important issue. The intent is the important issue. You have condemned the board on hearsay and unconfirmed stories. Contempt drips from your comments. In the end, you all appear sanctimonious and the board appears human. Keep up your good work.
