June 14 - Aug. 14, 2018

OMG, we got a shed epidemic.   11 sheds, but no houses.
This may solve our financial woes. Shed fines.

Looks like these members choose to do things by the rules. Good for them. This much add-on building is a sign to me that our area is prospering and people are enjoying their properties in Surfside. Like they should.

The structures may vary from the plans when built - how can you be certain ? Are all structures inspected after building ? Have they always been ? I believe it was a couple of years before anyone noticed that Johansen's shed was slightly different than the plans approved.

What you can be certain of, is that Johansen's neighbors didn't care or file a "complaint". That cul-de-sac isn't very developed - two homes in somewhat rough shape, and two other RV properties that are rarely used. One has a rented outhouse (legal), and the other has a shed with a porch (not cited for non-compliance).

The Board has failed in its responsibilities to enforce the covenants in a timely and fair manner. The choice to enforce covenants through complaints has proven to be a divisive, hateful and unfair option. Surfside would be vastly improved with an unbiased employee faithfully and fully enforcing the covenants with regular inspections and timely response to complaints as well.
Citing the gaps in fair enforcement with this stupid complaint policy does not excuse any failure to comply with the covenants. It is simply whining and complaining by another member who is a victim of the failure to fairly enforce the rules.

Johansen is an example of a person who likes to draw attention to himself as some others have also demonstrated. Being loud and visible does not make you right nor does it give you a pass on compliance with the covenants.

Enforcement needs to take into account the impact of any perceived compliance issue. It is likely that there are hundreds of sheds in the community that have never been inspected, and those on properties with homes have likely been given a free pass.

Case in point: The "shed" that was cited for non-compliance in the last month, and a matter of discussion at the last B. Mtg., was built many years ago, before there were any shed covenants. It is 190 sq. ft., and is plumbed. It is taxed by the County as a small cabin. The HOA was unaware of it.

Johansen has not sought to bring attention to himself, but as a duly elected Trustee, singling him out to make an example of him has made this a well publicized issue. He has not made his case a matter of Board Meeting discussion, nor has he focused on RV issues in Meetings.

At this point, he is likely to win payment of his legal defense costs, at the HOA's expense. Trivial issues such as this should never reach the Courts, and there is no shame in issuing a warning and dropping the compliance demand. It has NO impact on the rest of the community, and each such issue is to be judged on its' own.

I don't want my dues spent on this idiotic waste of money.

Bloggers that continue to belittle Deb, Patrick, and now Steve are evil spirited if you believe folks that don’t agree with your propaganda are disease infested, why not discontinue blogging on this site? You wouldn’t want to catch what we have!!!!!

Obviously, the fan club of these three people is unable to take a joke about a fantasy disease. It is true that these individuals all have a tendency to spout opinions as if they are facts.

Not to worry 4:09, I'm immune to the disease you and the others are infested with. I actually like it here. I guess that fact along with seeing the ocean and not coming on here everyday is like a vaccination.
