No EPA Violation?

Get your head out of the sand...



You will see in the Email below, the Email that I sent to James Clancy, the Board Treasurer and member of the Executive Committee with my concerns with the EPA violations.

He has the same Board Report from Bill Neal that I have and just published on the blog. He made sure that when he replied, he included members of the Executive Committee.

He said.."As far as I know there is no EPA  violation here at Surfside related to Asbestos."
What the hell does he think the report is about?

I admit here, that I was wrong. He, (James) has no guts.
I found his reply to my Email as nothing less than astonishing.

the blog host has had nice things and not so nice things to say about board members, employees and contracted employees and services over the years. the bottom line is that he has proven to be a poor judge of character more times than not. sadly, some readers and commenters based their voting on the hosts recommendations.

any board member is going to want to duck responsibility for the ongoing crappy decisions about managing our water system. have you heard anything from other board members. notice this - the RV, Tech committee, tree huggers have all gone silent.

Apparently the host had his head in the sand as well during BOTH times he served on the board. Funny how it is always someone else, isn't it?

George has shown to be a very good judge of character, because your cronies are doing a crappy job. If you truly care to see bad judgment, look in the mirror.

This curious part of this thing, is that James Clancy states that it is not a management issue. How can it not be a management issue? Board of Trustees controls the water program, than hires the water manager. Board of trustees evaluates performance and makes recommendations going forward.
Funny how all the garbage in this association always ends up at the same place. And I don't mean the compactor.

If there is no EPA violation, then why are we trying to hire a remediation contractor, and waiting to see if the HOA will be fined ? The buried material must be dug-up, bagged, and taken to a disposal location that can deal with the material because it is full of asbestos - why ? Because it is a blatant violation of State standards.

Is this the age of double-speak ? It is clearly a violation that it has been buried in a hole on the Waterworks property in secret, and now must be dug-up - so, how is it okay to leave replaced pipe, even if it is broken, in the hole and buried along with the new waterline ? That makes no sense at all.

And of course this IS a management issue. Who else would be directing these projects and funding them annually ? Mr. Clancy is unwilling to acknowledge the Board's complicity, while it is entirely obvious that the BOT is fully responsible for oversight, and are very much aware that this has been an attempt to sidestep State regulations.

Employers are responsible for all employee actions, period. Shoa is the employer. Time to move or start ponieing up.

That would help them to not be able to make further mistakes, but won’t save shoa from the costs.

We have to be realistic and recognize that Surfside employees need to live in the area, or be willing to relocate in our area. That may contribute to Mr. Neal's complacency, feeling that he can't be replaced. Our remoteness also contributes to the attitude that hazardous materials can be left on the edge of one's property, or buried in a hole and forgotten about.

Hanford would be an example of how this attitude can play out. They still struggle to find solutions, and pretend that employees lives have not been put in jeopardy. Nuclear waste was put in 50 gal. drums and dumped in the Carribean Ocean several decades ago.

Throughout the country there are instances of serious contamination of ground and water, and the expensive cleanups that follow can last for decades as well. This is an outdated way to approach these matters, and Surfside HOA needs to stop pretending this is not an issue.

Neal should be fired ASAP. Water contamination incidents and asbestos contamination is more than sufficient reasons to get rid of the clown. Other water workers have creds to carry on the necessary work.
