A Dark Cloud Hangs Over Surfside

Most members do not even know about it...

The fines and legal actions against Surfside have been kept from the members.  The elephant in the room is the EPA. With the government shut down, nothing can happen at this time with the EPA, but they will be back in action once the government re-opens.

Other than the usual cover up, the Board has been advised by their high priced mouth piece, to say nothing while legal action is pending. The Board members have been advised to retain their own private council. This suggests that there could be legal action against individual Board members as a result of the criminal investigation. Those Board members are not represented by the association attorneys or association insurance.  To put it in plain language, they are in a hell of a spot, which is where they deserve to be.

When you elect to be on the Board, you are bound by responsibilities outlined in our governing documents as well as County, State and Federal rules and regulations. This and former Board members  have been derelict in their sworn duties. Their lack of attention and incompetence has put us in the position we are today.

The general membership does share responsibility in this mess, partly due to their lack of attention and not voting in elections and on the budget.  However, that being said, the members have deliberately been kept in the dark as to the real problems that exist today and in the past.

I fear the worst is yet to come.  Will our association survive this?  The outcome of all this may be out of our incompetent hands. We could be dissolved, not by our choice, but by others. If that happens, there will no longer be any covenants and we will pay for water and garbage just like everyone else.  The State will not allow us to be without safe affordable water. It could even be more affordable and safer than what we have now.

It's just my opinion, but the sky may very well be falling.

I hope for a forced dissolution.
This SHOA BOT and business operation are terrible and corrupt people.
Those that claim I"m seeking to change our CC&RS for only my own interests are just using diversion tactics and proving their own hypocrisy.

Dissolution would be awesome... This HOA feels more like a local gang in a 3rd world country where we pay a fee for "protection" against the gang themselves. I don't use the trash, little water, and never see the cop on patrol. I've had stuff stolen off my property, and see no community unity other than the fishing derby. As far as I'm concerned, the only folks that would notice a difference are Thurston and Lovey Howell on the hill and a few trees that may creep up in their budget view.

Don't forget about the newly elected trustees. they learned about the legal issues in "secret" meetings and have done nothing to fix it. They are just as guilty as those who committed the crimes. Dumb and dumber.

I am all for dissolution also. Even though a part time RVer, I keep my property in excellent and eye appealing condition. Would enjoy having the opportunity to either build a small cabin or place a nice manufactured home on my lot. I think a lot more of us part timers would be supportive of ridding ourselves of the SHOA and BOT, the word just needs to get out to everyone somehow. Had there been any gofundme start up yet for a mailing?

Dissolution is the only answer. We are fighting a corrupt, vicious gang. We could protect our property much better tha Barney Fife. I use compactor when I’m there at my rv lot. Would gladly take care of that myself. Water is so iffy that we have a filter system. We are paying membership dues to fight the gang is right on. Go fund me for dissolution of SHOA. I’m in!

To Fed Up - If I spent more time on your rambling, English fractured post I might have some sense of what you propose.

And yes to a previous poster. I wonder what the time frame going back in time is on trying to involve Board members from the last 3/5/10 years for liability? 5/9 of them are assigned to a nebulous committee and are rarely/never involved in the inner sanctum.

Dissolution gaining ground? Just because George keeps milking this subject by constantly posting a new topic about it and the same few disgruntle buyers keep asking for it doesn't mean it's gaining ground.

And to those that also keep saying that the new Trustees are responsible, then why aren't George, Patrick and Deb too? They were on the board while this happened. Just because they quit doesn't absolve them.

And what secret meetings. Every time the board meets in close session certain Trustees or others go running to George and then he makes a topic about it. There are no secrets here.

Sorry to repeat myself but: just read the latest WEAKENDER! Why bother going to the trouble of this? Read Barney’s report. What a joke! Save some office staff time and eliminate this waste. Notice that not ONE thing is mentioned about investigations, lawyers, fines, bankrupting the HOA? This WEAKLY has become an embarrassment unless you want to know when Bunco is.

George, Patrick and Deb were all chased off of the BOT for not being willing to rubber stamp the majority's agenda. Were that not the case, you would have a point 6:27. They saw the disregard for open governance and State mandated procedures and did not want to be a part of it.

While it is true that no one that has served on the Board has sounded the alarm over the Asbestos mishandling, I think that the president of the Board has the responsibility to oversee procedures used in the Water Dept., and be able to assure the membership that those procedures are appropriate and safe. That has not happened in years. That makes Flood and Williams the two most key to this oversight.

The fact that Williams and others have pursued yet another lame lawsuit, this time over tree heights, in the midst of a serious community crisis, is so irresponsible it seems as if they think the EPA investigation is a joke. They have no sense of responsibility at a time when we are already deeply in debt.

Since assessments are pouring in they're spending freely on this ridiculous lawsuit while fines are mounting in 5 figures, $60,000 is needed to replace carbon in the new plant, and the new filter columns have no enclosing building. We are deeply in debt to our Reserve Acct. which is also monitored by the State, and requires repayment. We are surely already in debt in the range of a quarter million dollars, and that will be going way up as the EPA concludes with Surfside's case.

Let's get real. Blagg manipulatively resigned from the board the day before the annual meeting so that she could play her dirty, overbearing tricks at the meeting. Patrick learned that he couldn't have things all going his way and sold out. George is over sensitive to criticism and resigned twice from the board due to his failure to buck up under pressure.

Shill?, takes one to on 11:38 AM. I think anyone that has served on the board and possibly worked in the SHOA office over the last 10 + years may need to lawyer up whether you are guilty or not.

I guess 10:47 thinks I am stupid. He is trying to prod me about a lawyer, stupid questions, etc. so it will give the defense, information on information to save their ass. Not going to happen. Same old BS of attacking the messenger. When these law breakers go to jail, I hope it is near where their relatives live so they can have visits. And to another comment on my information on secret meetings, yes, I got it from the WeakEnder. As for being "sensitive" and "hitting a nerve", dream on, I am only bothered by the incompetence of management and unfair treatment of members. No or low comprehension keeps making stupid comments over and over. You can't fix stupid with duct tape, but you can muffle the sound. That's what I try to do with no comprehension on here.

10:16 You wouldn't know "real" from "can't believe it's not butter". You are dodging the crux of the matter, as many of the folks that the status-quo best serves will choose to do.

We can blame Bill Neal for everything and pretend that there was no way 9 Trustees on the HOA Board would have known (over several years), coincidently, no one ever asked Bill Neal why there was a huge pile of broken asbestos pipe on the Water Dept. lot, even though Neal was required to attend Water Dept. Comm. meetings, and often attended monthly Board meetings. And why would we hold North Beach Water responsible for oversight as well ? Reminds me of Alfred E. Newman's famous saying: "what, me worry ? "

In fact, ALL of these folks had knowledge of improprieties at the Waterworks, and they either didn't piece the info together, or they just decided it was someone else's problem. Both North Beach and Surfside had the responsibility to safeguard the health and safety of workers and residents in Surfside, and no one took any personal responsibility or apparently, actually cared.

We still have heard no word of apology from the Surfside Board, who allowed workers to put their lives in jeopardy rather than make certain safe procedures were being followed.

Looking forward to the day when EPA issues warrants for the arrests of the criminals. A board meeting would be a good opportunity to get them all in one grand sweep. Hope George is there with his camera and recorder. Flood will probably flee to Mexico.

I don't plan on missing a board meeting for anything for a long time so I can witness that event.

Gary Williams told me yesterday via email that he isn't sure if SHOA hasn't complied with WA L&I's 2013 instruction to SHOA for implementing an Accident Prevention Plan.

Save that Email. EPA may find it of interest. I was informed that the EPA had issued a court order for all Emails and documents related to the AC pipe. These criminals have been caught.

1:26.... Read my previous comment at 10:09 again. Your question is fishing for an excuse for the obvious key Trustees in all of this. The views of George, Patrick and Deb were ignored by the majority of the Board because they asked too many questions and dared to have independent views.

Neither George nor Larry Raymer supported the waterline replacement project, and Patrick and Deb were just ignored and marginalized. They saw that honest even-handed governance is not on the Williams agenda and left.

All on the current Board are contributing to the deception of the membership at this point.

Those Board members were discriminated against, and marginalized, all because they brought new ideas to the table. The hand selected, inbred Board wanted it their way, and drove them out.

We don't need them all hauled off in handcuffs. A simple letter of resignation would suffice nicely.

I don't think there is enough information available to predict whether individuals will face criminal charges or not. The ridiculous contract for the Water Dept. manager, makes him responsible for virtually everything, including permitting of construction. He is an employee of North beach, and a contracted employee of Surfside. There is no side-stepping responsibility and requirements of oversight by these two large entities, so it isn't that simple.

I submitted a public records request of North Beach Water Department for SHOA matters. They have refused to respond to my pubic records request. Imagine that. Clearly an attempt to cover up and hide, corruption.

To make sure he isn't successful, after I noticed he interjected his personal email account into the communication I then sent the email string to his surfside.org email account.

Surfside and North Beach are in collusion to hide the truth. Evil people are in control and only care about themselves. North Beach is just as guilty as Surfside, if not more. Surfside does not sue North beach because of their collusion. They all belong in jail. They are a bunch of corrupt crooks.
