Department Of Labor And Industries (L&I) part 2

Repeat posting for those who question if there are documents

Public disclosure reveals the truth that your association keeps hidden from the members. So far we have 10,000 in County fines and the 27,000 disclosed here.  We are waiting for EPA violations and fines.   The Board asks us to approve a budget with the same ones responsible for this mess to continue?  They are even rewarded with a raise and bonus plus increase to North Beach Water.  This is crazy.

Below is a response to one or several complaints filed with L&I.  This contains new information that I was not aware.

The lawsuit That Will be brought by past and present water employees will make this look like chicken feed.

The fines will cost us all about $130.00 so far.

Where have u been. Already been proven. Now just about the cost, and the ongoing EPA criminal investigation. How bad does it have to get before people wake up?

$130.00 (one hundred and thirty dollars) total of fines so far simply does not make sense in view of the documents regarding some of the fines.

This is only the L&I portion. There had been talk of further fines by the EPA. Can anyone determine if this is all, or can we expect more fines to follow?

EPA fines will be on top of this, and the HOA may be on the hook as liable for any health issues employees may experience in years to come. Williams had claimed that insurance would pay most of the legal fees spent on the Johansen lawsuit, but that is unlikely given that the HOA withdrew the lawsuit.

So all of that cost is surely lost, and the members the losers. That may mean that the community has some hope of relief from insurance in the asbestos settlement.

I don't think our insurance will pay for dereliction of job responsibilities, we are on the hook or at the best case Neal is on the hook.

Employer is responsible for employees. Neal is an employee..we are the employer. Not rocket science. We on the hook folks.

He isn't an employee. He was contracted. When I hire a contractor, they are libel.

Don't lay down and take this. Hold those responsible, accountable!!

Lawsuits inevitably go after the deepest pockets. That is not Bill Neal regardless of his culpability.
It's not going to go away that easy.

I believe SHOA contracted with North Beach Water to manage the system. Neal is the employee/agent of North Beach Water. So I believe North Beach water is responsible for this. That said, everybody gets sued, anyway.
It looks to me like SHOA needs to be suing North Beach Water to pay those fines, and for breach of contract, and for negligence. SHOA's insurance agent should be paying for SHOA's legal fight in this.

It's interesting that the BOT didn't think there was any reason to meet this month, given all that is going on, and the many questions owners must have. Yes, I know that there is usually no December meeting - so what ? We can be sure that attorneys are being consulted on our dime, and that BOT decisions are being made outside of open meetings, in the cavalier manner Williams has operated since he was re-elected to the BOT.

9:26 Perhaps you didn't read the "Weakender" with the so-called minutes of the secret Board meeting that was held recently. Immediately went into closed session. Was interesting to see the usual band of ner-do-wells were appointed to come up with a job description for the overisght of Surfside's "Business/Field Water Operations". Does this mean one person to replace the current ineffective two persons? Does this mean they have or are planning to do away with Mr. Neal? or elevate him to be the business manager as well? Sure wish the Board would let the owners know what is going on. Perhaps K. Olds and A. deLeest will elevate P. Olds to be the guru!
