It wouldn't surprise me if it is the Tree Committee that is all of a sudden generating
all these new complaints, very unusual increase in activity.

This report makes it clear what a ridiculous obsession enforcing this policy has become. I keep asking how many inches over the established limit justifies a demand for compliance, and no one is willing to say. Is 4 inches over 14 feet an urgent matter requiring measuring, sending a compliance letter, hounding the owners, threatening fines, owners spending hundreds of dollars to placate the OCD Tree Committee ?

This is beyond nuts. The community is being victimized by a useless policy that demands owners destroy their private property to satisfy a myth that the community is better for it. This assures that Surfside will always be second rate as an HOA community. Enforcement for enforcement's sake is lunacy.

Again, more attacks against the tree committee from Mr. 4:49. The tree Committee doesn't need to be placated. All they do is go out to measure and determine if a complaint is valid, nothing more. To continue to blame them while excusing those that actually made the complaint and those that let their trees get to the point of having one filed shows if anyone has OCD it's 4:49.

More information you don't quite understand. There isn't an answer to how many inches over requires a measurement. No trees get measured unless there is a complaint. There are many incidences where the measuring has determined the trees are within limits.

Maybe you should consider either talking with someone on the committee and/or show up for a meeting to educate yourself instead of making the same inaccurate statements. But why bother, right? Easier to just continue the attack.

Maybe you should consider the rest of the members before flapping your pie hole, but we both know that's not going to happen. Go back to J Place.

53 complaints, this is a good thing. looks like members need to pay more attention to their tree heights. Manage your trees folks!

And kudos to the Seacrest condo owners who want to be proactive. If more people were like this we wouldn't have the 53 complaints.

There's no point in pretending that there is anything beyond my understanding, and you are unwilling to state how many inches constitutes a violation. That tells me that we will all find the answer ridiculous and obsessive.

Tree and home heights on G St. are 24 feet. Add to that how high the property sits, and that houses are being built about 8 feet apart. The dunes in some areas are 24 to 28 feet high. Virtually every tree between the ridge and G St. have been topped at least once, probably multiple times. They will never grow high enough to interfere with views. Stop pestering owners and forcing them to spend money on this nonsense.

Much of the wasteland in between the ridge and G St. could be Nebraska by the way it looks so barren and chopped. No need to pretend that you are the innocent community servants. You as well as anyone else can recognize what a useless exercise this enforcement is, and tell the Board it's time to have a 2 year moratorium on cutting.

So you have 76 properties slated to be cited and cut, and 3 properties referred to the attorney. That tells us that a great deal of money is also being spent on attorney fees for legal advice. The HOA just withdrew a lawsuit pursued in Superior Court over a tree related issue, at a loss of at least $55,000. That was on top of the total loss of at least $100,000 pursuing the Patrick Johansen case, which could have easily been resolved by granting him a variance.

This is the adversarial attitude I have commented on. The HOA is in deep trouble with regulators for failing to follow regulations in building permitting, management of the Water Dept., and failing to address need for wastewater solutions. Meanwhile they can't stop creating conflict with owners on the flats. That's called hypocrisy.

Deleest just got a height variance approved by the board. I wonder if these 76 properties will get the same. I think not. What goes around comes around. These 76 properties will spend thousands to comply while the smug board members who live on J and sit on the tree committee pay nothing. Bad karma

Neighbor of mine got a tree letter. Cut his trees at a big cost. Tree Committee person came around and measured tree as being 2-3 feet above what they actually were. How many times has “Laser Lady” made this mistake on others? Lawsuit?

Question to ask every board member and board candidate. Do you support a tree height covenant? Get them on the record. Those who support should be exposed and removed by the community. Those 53 should all refuse to cut their trees and let them take them all to court. This BS would all end on the first court decision.

No secret that we support the covenants, that's why we purchased our property here. You don't see me commenting on anyone living in any particular area of Surfside so you should not either! If going anonymous were not allowed you wouldn't have the guts to post your threats and garbage comments.

To 1:31: Removed by the community? Really? How exactly do you think that could happen? Does that mean if there is a candidate like Patrick who says there should be no covenants here we can remove them?

Patrick is more of a man than Fred or his wife will ever be. They are only hate and anger. Patrick was for all the members, not just the elite on J Place. Only covenant they support is the one to make people kill their trees. If they moved here because of the covenants, does that mean they will move away if they are changed? If I was them, I would hold off on any purchase.

Complaints are supposed to be filed by members, not just one individual. Do you think that there are 73 individuals out there each with a complaint, or just 2or 3 hungry for power? Would like to know,, by Street, where the violations are. How many do you think are on J Place? They should share in the complaints. I am sure we can find violations other than trees, but would Laura enforce. She knows who butters her bread!

Whatever happened to the Constitutional right to know your accuser? Each and every complaint and the name of the person filing that complaint should be available to each a very person affected by the complaint, it is a Constitutional right, not at the whim of the HOA, they are not a law making body. Make policy, OK, but violate the rights of the accused, NO!

Why should deleest get special treatment for her height variance. Is she not one to claim you knew the rules when you bought here. Except for her of course. Then she leads the charge on getting trees cut and her husband comes on here and claims its no ones business. Well pal she ran for the board and got special treatment it is everyone's business.

Mr. deLeest...The current mutation of the Tree Policy has evolved in its' language from protecting ridgetop views to being cloaked as a general height restriction. That you have financial means is great fortune and in itself no reason to be maligned, I agree. But promoting the merits of the policy IS elitist, and the policy, damaging to other member's private property.

The fact remains, that the policy only serves ridgetop owners' interests at the expense of owners to the west. Views are not in any way obstructed by trees below, and if the policy was done away with, that would not change. It should not be surprising that elitism breeds contempt.

The community is intended to be fairly and equitably administered, but has a proud tradition of NOT doing so. The Tree Policy is the key to this imaginary class structure, and the privileges some owners feel they deserve, even at the pain and expense of others.

The Policy needs to be eliminated, allowing for individual appeals regarding neighbor trees, with an on-site determination as to whether "views" are obstructed or not. I think we would see not more than a handful of trees cut annually. This policy serves no one in the final analysis, but maintains a false elite, and in so doing, creates needless conflict and pain.

This is a private property matter and opposition is not driven by jealousy. That is a smug elitist attitude as well.

It is interesting that you defend this policy so, and have denuded an entire hillside on the property you intended to build, which will contribute to community flooding, another serious problem that Surfside refuses to address or cooperate with the County to solve.

Can anyone tell me at the beginning when the Covenants were first drawn up, what was the basis used to structure the tree heights in Surfside? Does anyone really know the answer ?

4:33pm, your comment is well founded. I am not a Lawyer, but I do know this, a VIEW is not included in your purchase of property, that alone means the covenant on tree heights is illegal and would not stand up in court.

Russ, they've kept their position by repeatedly stacking the deck, making the covenants the exclusive province of the Board, then hand selecting the Board members.

It's the Mexican tree trimmers. They cut your trees then charge you to haul the branches away, then they dump where ever they can for free. Lucky it's only tree branches, that goes away with little disturbance to the wild life.

Bought his property knowing full well the trees were over height and did nothing until he got a complaint.

Submitted plans for a tiny home, sorry I meant "shed", then changed them which is against the rules. Then instead of first appealing the complaint against him he went running to a lawyer instead.

When he found out that he couldn't put in a septic because of the close proximity to the canal he tried to change that rule also.

Every issue he championed was for his own self interested. It might align with yours but it doesn't change the fact that his motives were just as selfish as you accuse others of being.

9:45. The reason for you not knowing is to avoid retaliation. Why do you need to know anyways? All that matters is if the complaint is valid or not. That's how an HOA works. The Constitutional right you have is the freedom to purchase elsewhere.

9:56: As was mentioned your fixation on the de Leest family borders on psychotic. The variance request is no different then what has been given to others. To say it is special treatment is only your bias opinion based on some sort of hate.

I don't really care for examples of other HOA's since we know this one is not working. The ability to face your accuser is a key to American jurisprudence. Almost hope I'd be picked on, because there will be good money to be made in this lawsuit.

The point 10:04, is that the lot was cleared, but the lot was rejected as the deLeest's building location. It's a very steep lot and will contribute to the wastewater woes that challenge the HOA to find solutions. The county has installed large storm drains on I st, but runoff still causes flooding in some areas.

Living trees and bushes absorb much of the rainwater and help drainage. The remaining lot makes a raggedy spectacle for everyone to live with.

10:00....Maybe you're not too good at math. The point that was made at 9:41 was that the "issue" did not merit 2 years of harassment and legal costs of over $100,000, when a variance could have been granted, and a warning to be fully approved in future projects, would have sufficed.

In spite of the large bank account member fees provide, it makes no sense to be unwilling to negotiate resolution in some instances. Patrick held that County standards allow the small porch, which is true. His attorney tried to schedule mediation at a cost of about $100, and the BOT refused to meet and settle out of Court. They ended up withdrawing the case at a total loss of funds.

Patrick sold his property, and the new owner sawed the porch floor off, and dumped it haphazardly in the bushes a few feet away. The roof still has the overhang, which is structurally unsupported. So what was gained by this relentless enforcement action and vast waste of money ? Now a mess lies in the bushes where a nice shed stood, not bothering anyone. Sheds are like that. They pretty much keep to themselves.

It's not their job to tell people anything, just measure the trees and determine if the complaint is valid. That's the job of the office. What does the day of the week have to do with anything? So are you saying that if a complaint is made against you and ladies or Raymer show up to measure your going to be less than civil towards them? Go ahead then be prepared for a visit from the deputy, if you're lucky.

You can continue to call those on the committee what you want but cowards doesn't apply. They put up with more crap from you big, brave anonymous keyboard warriors than you ever could.

I feel very sorry for the deLeest's and the Old's. They are getting picked on by a bunch of jealous people. If I was them, I would say to hell with all of you, and quit everything. Resign from the board and committee. That would show them as everything would fall apart. I knew the covenants when I moved here, and I expect to be kept in line so that I will be a good member. We need good people like them to tell us what to do, otherwise, we would all continue to be law breaking criminals. I am jealous that I am not as good as they are or live in a fine home like them. We need fine people like them to keep us in our place. Sometimes we get a crazy notion that we are as good as everyone else and want to be treated fairly. -I am also jealous that they are so smart and I am so dumb.
