Thank the homeowner for "killing their own trees.

Now if you wanted to be fair, which of course you won't, you would show at least 1 picture of a lot where the people took care of the trees properly and they are alive and well. There are many such properties to choose from.

Now let the usual comments commence.

Tree hights are not a ounty thing it is a Surf Side thing.

The Tree Policy is based on preservation of views for J Place owners, about 15% of the owners in Surfside. The covenants were purged of mention of guaranteed views, in favor of a much more intrusive Height policy and micro-managed parcels `throughout most of the westside. It was instated as an elite privilege and has continued to be, in spite of RCWs that forbid discrimination, which this perpetuates.

It was never intended to be fair, and in spite of Trustees being bound to govern all members fairly and equitably, they have never endorsed ridding the community of the burden this policy brings to member relations. Some trees have survived well, while most have died and/or been cut down because of poor health, and the expense of topping at least every other year.

Properties with the most stringent restrictions of 12 or 14 feet have mutant trees that look like umbrellas, or many have cut every tree on their property. While property values have flatlined on the ridge, properties in these more barren micro-plats have seen property values decline. Is that fair Mr. anonymous 5:10 ? Tell us about fairness.

Why does the CC&Rs 08-18-18 document state something about county limit of 35'
I want evidence of the beginning of thisrestriction, the beginning language, the amended language, and any other information.
Does anyone have this?
Do I have to submit another Pacific County public records request?
What year was the tree restriction implemented in the CC&Rs document?

In my opinion, the tree policy should remain as it is. That's what I signed up for. If you can't take care of your property according to the covenants you either need to pay someone assist you or move.

and before all you start spitting and cursing at me showing how jealous you are of my beautiful ocean view on J st, etc, ....I live on H and my trees have been maintained for many many years.

The earlier poster was correct, George never or rarely shows the lots that are trimmed nicely.

How long ago did you sign up? Was it this century or last?

George's illustrating a large problem in our community, a problem you support and exacerbate. Tree policy is neither consistent nor fair. Thats all I want, but fairness was sacrificed to special interests long ago.

It doesn't matter when I singed, I agreed to the covenants and still will until if/when they change. And it was this century

What you signed up for is a community with rules and standards that can be changed at any time by a prescribed process. Unlike most HOAs, Surfside leaves all the authority in the hands of the Board of Trustees. Most communities require approval by the membership, as it should be.

Your Board of Trustees has proven themselves incompetent and untrustworthy, as the recently revealed EPA Criminal investigation has shown. Member funds have been freely spent without public disclosure on County, State and Federal fines for wrong-doing, yet the Board refuses to disclose that any of this has/is occurring.

Well over $100,000 has been spent on two lawsuits that were then withdrawn, while County, State and Federal regulators have found numerous serious failures of HOA management. Legal spending on this has not been revealed, but is assured to be extreme - and not properly approved or disclosed.
For this reason, owners need to rally to reel-in the BOT by approving 3 or 4 measures at the next member meeting in July.

Eliminating the need for proxy voting by establishing an electronic option, and continuing the mail-in option, will prevent inappropriate block voting by Trustees, enable more votes cast by the internet option, and require voters to make their own decisions to cast a vote. Voting would take place well before the Annual Meeting so that results are known at the meeting.

Another measure would have Covenant changes require a member vote, changes only becoming valid with member approval. A threshold would be established for approval, such as 60%, more or less. This would help give owners more say in HOA matters.

Whatever you may think about the Tree Policy, there is a need to tip the scales in owner's favor where abuses of power have run amok, cost the community dearly in dollars, and demonstrated an inability to manage effectively and conscientiously. Only the members can make an impression on a BOT that feels no obligation to be honest, fair, and transparent as is required by law.

Reading the kill tree minutes under Member Contacts:

"Peggy spoke with another property owner who was concerned about protecting at an old growth tree could that was not on his property"

Could someone translate that for me? If they are going to write on and on and on, can they do it so it makes some kind of sense?

Does anyone know that cutting or topping trees to preserve someone else's view
would not stand up in a court of law. When you buy property you buy the land, you do
not buy the view.

2:11 you agreed to the CC&R's so you would have no case. Why don't you get together all the people who wants the heights removed and add it to the members meeting? That's how you can make the change. I'm guessing we won't see any such action it's just all blog talk.

11:13 You do not get the point. You fall back on the same old same old "you signed up etc. etc.
Reg's can always be changed if they make no sense. Example: My neighbor has a tree height limit of 24', mine is 16' our lot's a five feet apart yet we do not block anyones view on J place. Makes lots of sense right.

1:36 I do get the point, people complain but take no action. I see this everyday here, complaining, but is anyone actually doing anything to make the changes? It is possible but people have to get up and stop complaining and act if they want change. I don't agree with all the different heights around here but I don't sit on here and complain about it either.
